Who we share your data with?

If you are the borrower, we will share relevant data with the guarantor (where product appropriate). We may also share your personal data with any member of NSF Group and with the following categories of third party. How we protect your data

The security of personal information about you is our priority. We protect this information by maintaining physical, electronic, and procedural safeguards that meet or exceed applicable law. We train our employees in the proper handling of personal information. When we use other companies to provide services for us, we require them to protect the confidentiality of personal information they receive.

There has been an upsurge in email 'phishing' activity, where fraudsters send emails to customers and using an array of deceptions, encourage them to give out sensitive personal banking details. Please note, that we will never ask you to send your personal or security details or update them via email, and if you are ever asked to do so, please call us first.

If you have received a phishing email, we advise you to forward the email to [email protected] and we will investigate it.

IMPORTANT INFORMATION - We need to collect personal data from you for performance of a contract and for compliance with our legal obligations. You may refuse to provide us with your personal data at any time in our relationship because you object to such processing but if you do so we will not be able to provide you with credit or may have to terminate our relationship with you. If you do withdraw consent where we have asked for it this will not invalidate the use of your personal data prior to the withdrawal.

 

Sending Personal Data outside the EU

We may send your personal data outside the EU in order to enable us to perform the contract, comply with a legal obligation or where we have a legitimate interest in so doing. Currently we have one data processing relationship outside the EU with a South Africa processor. We ensure data security with this processor by means of a contract.

Before we send any personal data to an organisation outside the EU we will make sure it is protected to the same or similar standards as if it was being used within the EU by means of contracts between us and the overseas processor or in reliance on the EU Commission’s finding of that country having adequate data protection provisions in place.

If the personal data is processed in the USA we will ensure that the processor is subscribed to the Privacy Shield which establishes common privacy standards between the US and EU.

 

Automated Decision Making and Profiling

Prior to any loan (or guarantee) being agreed with you we will use your personal data to make automated decisions. This is done in order to determine whether we wish to enter into a contract with you and to determine your creditworthiness in the quickest, fairest and most legally compliant way using credit scoring and past payment history to predict future performance. We will also monitor your account using automated means for fraud detection and crime prevention purposes.

The automated decision may result in us declining your loan (or guarantee) application altogether or offering a lesser amount than that sought.

We regularly test our credit scoring model to ensure it is working appropriately and accurately.

If you are dissatisfied with the result of this automated processing you have the right to seek an explanation and request a person review the decision.

 

Sharing your data with Credit Reference and Fraud Prevention Agencies

In order to process your application, we will perform credit and identity checks on you (and any guarantors) with one or more credit reference and fraud prevention agencies (“CR/FPAs”).

To do this, we will supply your personal information to CR/FPAs and they will give us information about you. This will include information from your application and about your financial situation and financial history. CR/FPAs will supply to us both public (including the electoral register) and shared credit, financial situation and financial history information and fraud prevention information.

We will use this information to:

We will continue to exchange information about you with CR/FPAs while you have a relationship with us. We will also inform the CR/FPAs about your settled accounts. If you borrow and do not repay in full and on time, CRA/FPs will record the outstanding debt. We will also report the guarantor (where product appropriate) in the event they do not repay the same after we request payment. This information may be supplied to other organisations by CR/FPAs.

When CRAs receive a search from us they will place a search footprint on your credit file that may be seen by other lenders. If we notify them of criminal activity on your account they will keep a record of this which may result in other organisations refusing to provide you with services or employment.

If you are making a joint application, or tell us that you have a spouse or financial associate, we will link your records together, so you should make sure you discuss this with them, and share with them this information, before lodging the application. CRAs will also link your records together and these links will remain on your and their files until such time as you or your partner successfully files for a disassociation with the CRAs to break that link.

Data Retention

We will process your personal data for either as long as you (or the guarantor) have a contractual relationship with us or you continue to owe us any repayments. If you stop being a customer after repaying your loan in full we will keep your personal data for no longer than 6 years. We do this because we are obliged to hold transactional data for 5 years by law and in order to answer any regulatory inquiries or respond to any complaints during this period.
